We’ve drafted these Terms of Service (which we simply call the "terms") so you’ll know the rules that apply when you use the VoxiGen app or any of our other products or services that link to these terms (we call them the "services"). While we’ve tried to keep the legalese to a minimum, some sections may still sound like a traditional contract because these terms form a legally binding agreement between you and NikolaTec, the company behind VoxiGen.

By using the services, you agree to these terms, which are presented to you (i) when you first open the app and (ii) when we make any material changes to the terms. If you don’t accept these terms, you shouldn’t use the services.

1. Who Can Use the Services

• No one under 13 is allowed to create an account or use the services. Additionally, you must be old enough to consent to the processing of your information in your country.
• By using the services, you confirm that you can form a legally binding contract with VoxiGen and that you will comply with these terms and all applicable local, state, national, and international laws, rules, and regulations.
• The services are intended for personal and creative use. If you want to use VoxiGen for commercial purposes, please contact us at support@voxigen.io.

2. Your Account

To use the services, you need to create an account. Here’s what you should know:

• Username and Profile: When creating an account, you’ll choose a username, which is visible to other users. You can also upload a profile picture to personalize your profile. Remember, your profile is public by default and may be visible to the VoxiGen community.
• Email Verification: You’ll need a valid email address to create an account. We’ll send you a verification code to confirm your email, which helps keep your account secure. If your email address becomes invalid, you’ll need to update it to continue using the services.
• Account Security: You are responsible for keeping your account secure. If you suspect unauthorized activity on your account, please notify us at support@voxigen.io so we can help.

3. Voxel Creations and User Content

VoxiGen is designed to empower you to create and share your own voxel-based worlds. Here’s how we handle your creations:

• Your Creations: Anything you create using VoxiGen, including voxel worlds and assets, remains your intellectual property, but by using the services, you grant VoxiGen a non-exclusive, royalty-free, worldwide license to display, distribute, and share your creations with the community. This allows us to showcase your work within the app and promote VoxiGen.
• Sharing: By default, your creations are public and can be viewed and explored by other users. You can choose to make certain projects private if you don’t want them shared with the broader VoxiGen community.
• Prohibited Content: You may not upload or create content that is illegal, harmful, or inappropriate. This includes but is not limited to content that contains nudity, hate speech, violence, or content that infringes on others' intellectual property rights. If you see any such content, please report it to support@voxigen.io.

4. Location-Based Services

VoxiGen includes features that may use your device’s location to enhance your experience. Here's how that works:

• Location Data: Some features in VoxiGen may rely on location-based data to connect you with other users or to enhance collaborative projects. You can enable or disable location-sharing at any time through your device’s settings.
• Accuracy of Location Data: We strive to provide accurate location data, but factors like network availability or GPS limitations may affect the precision of location features. We recommend that you use the services in areas with strong network connections for the best experience.

5. Rights We Grant You

VoxiGen grants you a personal, non-exclusive, royalty-free, worldwide, non-transferable, and non-sublicensable license to access and use the services for personal, non-commercial purposes, as permitted by these terms.

• Software Updates: We may automatically update VoxiGen to improve performance or add new features. You agree to these updates, which may be installed without additional notice.
• Restrictions: You may not copy, modify, distribute, sell, or lease any part of our services, nor reverse engineer or attempt to extract the source code from the software, unless laws prohibit those restrictions or you have our written permission.

6. Privacy

Your privacy matters to us. You can learn how your information is handled when you use our services by reading the Privacy Policy. Please review it carefully to understand how we collect, use, and protect your information.

7. Respecting Others’ Rights

VoxiGen is a creative and collaborative platform, and we expect all users to respect the rights of others. You may not use the services to:

• Violate or infringe someone else’s rights of privacy, publicity, intellectual property, or any other legal rights.
• Harass, bully, or intimidate others.
• Share offensive or harmful content.

Likewise, you may not use any of VoxiGen’s intellectual property, branding, logos, designs, or other assets without our express permission.

8. Safety

While we do our best to keep VoxiGen safe, we cannot guarantee it. By using the services, you agree not to:

• Engage in illegal activities using VoxiGen.
• Use automated means (such as bots or scrapers) to access the services.
• Interfere with the operation of VoxiGen or compromise its security.
• Encourage others to violate these terms.

Remember to always use VoxiGen responsibly and in a way that doesn't interfere with the safety of others.

9. Modifying the Services and Termination

We are always working to improve VoxiGen, which means we may update or modify the services from time to time. This may include adding or removing features. If we make major changes, we’ll do our best to notify you, but we can’t guarantee it in every case.

You can terminate these terms at any time by deleting your account. VoxiGen may also terminate your access if you violate these terms or for any other reason.

10. Liability and Disclaimers

We provide the services “as is” without warranties of any kind. To the fullest extent permitted by law, NikolaTec and VoxiGen disclaim any warranties, express or implied, regarding the services. This includes, but is not limited to, any warranties of merchantability, fitness for a particular purpose, or non-infringement.

VoxiGen and NikolaTec are not responsible for any indirect, incidental, special, or consequential damages arising out of your use of the services.

11. Dispute Resolution

If you have any issues or concerns, we encourage you to reach out to us at support@voxigen.io so we can help resolve the matter. If necessary, any legal disputes will be handled under the laws of Serbia, and any litigation will take place in Serbian courts.

12. Final Terms

These terms form the entire agreement between you and VoxiGen. We reserve the right to modify or update these terms at any time, and we will notify you of significant changes.
